Ratio Decidendi

The court found that the applicant has an undoubted right of appeal and that there are special circumstances, namely the impending eviction from the suit property, which would render the appeal nugatory if stay is not granted. The court held that the application was brought without unreasonable delay and that the applicant satisfied the requirements under Order 42 Rule 6 of the Civil Procedure Rules. Accordingly, the court exercised its discretion to grant a stay of execution of the judgment and decree of the subordinate court, conditional upon the applicant depositing Kshs. 25,000 as security for the due performance of the decree within thirty days, failing which the stay would lapse.
