The only competent authority to confirm such appointment is the Chief Registrar of the Judiciary, whose letter confirmed Odongo was not a Commissioner for Oaths. The affidavits purportedly commissioned by her were therefore not valid affidavits but unsworn statements. Rule 12 of the Elections (Parliamentary and County Elections) Petition Rules, 2017, requires that responses and witness evidence in election petitions be supported by valid affidavits.
