Ratio Decidendi

The court found that the plaintiffs, having been married before their father's death in 1968, were disqualified from inheriting the suit property under Kikuyu customary law, which governed the estate as the Law of Succession Act was not applicable to deaths before 1981. The court held that the only son, George Gikuhi Mburungo, was the rightful heir, and there was no evidence of a customary trust in favour of the plaintiffs. The subsequent registration, subdivision, and transfer of the land by the defendants were therefore lawful, and the plaintiffs' claim for a declaration of trust and related reliefs was without basis.
