The court found that the applicants had demonstrated substantial loss, as they faced imminent eviction if the stay was not granted. The evidence of risk of eviction was unchallenged. The court exercised its discretion to grant stay of execution, conditional upon each applicant depositing Kshs 100,000 as security for due performance of the decree within 15 days. Failure to comply would result in automatic lapse of the stay orders. The court was satisfied that the application was not filed with unreasonable delay and that the interests of justice required preservation of the applicants' positions pending appeal. Costs were ordered to be in the cause.
