The High Court found that the trial magistrate erred in awarding damages for loss of future earnings, as the respondent retired at the normal age and continued to earn his pension; there was no proof that the accident caused premature retirement or actual loss of income. The court held that prospects of promotion in the military are not guaranteed and depend on the Defence Council's discretion. The award for loss of future earnings was therefore set aside. Regarding general damages for pain and suffering, the court found the award of Kshs 1,200,000 excessive given the nature of injuries (3% permanent disability, full recovery expected) and comparable case law.
