Ratio Decidendi

The court found that the trial magistrate failed to comply with Section 333(2) of the Criminal Procedure Code by not accounting for the period the applicant spent in remand custody prior to sentencing. The court further noted that the pre-sentence report had recommended a non-custodial sentence and that the applicant was a first offender who had already served more than one year of his sentence. Given these circumstances, and the absence of opposition from the prosecution, the court ordered that the applicant's sentence should be deemed to have commenced from the date of arrest and that the balance of the sentence be served on probation for 18 months as recommended in the pre-sentence...
