Despite her assertions of non-involvement and efforts to have her name removed, she provided no evidence that the Registrar had effected such removal or that she had legally resigned. The court held that only the official records can be relied upon to determine company officials, and in the absence of any change to those records, the 3rd Defendant remains a proper party to the suit. The application to strike out her name was therefore misconceived and without basis.
