Ratio Decidendi

The court found that the Bill of Costs was improperly drawn in the name of the wrong party, as the Plaintiff firm of advocates was not the party that suffered loss from the breach of the professional undertaking. The Taxing Officer's dismissal of the Bill was based on the absence of a proper relationship between the Plaintiff and Defendant for purposes of party and party costs. The court held that the only way forward was for the Plaintiff to file a fresh Bill of Costs properly addressed, in compliance with the order of Njagi J. The application to set aside the Taxing Officer's order and reinstate the Bill of Costs was therefore dismissed with costs to the Defendant.
