Procedural Posture

Miscellaneous Application / Reference Against Taxation of Advocate Client Bill of Costs

  1. 1 Whether the High Court of Kenya has jurisdiction to tax an advocate-client bill of costs for services rendered in foreign proceedings where the contract for legal services was executed in Kenya.
  2. 2 Whether the Taxing Officer applied the correct schedule of the Advocates (Remuneration) Order in taxing the bill of costs.
  3. 3 Whether the Taxing Officer exercised her discretion judiciously in assessing the instruction fee and other items in the bill of costs.

Ratio Decidendi

The High Court of Kenya has jurisdiction to tax an advocate-client bill of costs where the contract for legal services was executed in Kenya and both parties are domiciled in Kenya, even if the substantive legal work related to foreign proceedings. The Taxing Officer correctly found jurisdiction and applied Schedule V of the Advocates (Remuneration) Order, as the proceedings were not before the High Court of Kenya. However, the Taxing Officer erred in assessing the Applicant's role as merely advisory and in awarding an instruction fee that was manifestly inadequate given the complexity, value, and importance of the matter. The Applicant's bill of costs was drawn under the wrong schedule,...

Court Disposition

Reference partly allowed; instruction fee increased; fresh bill of costs to be filed for further items if desired.

Orders

  • The taxed instruction fee is set at KES 25,000,000 for the Applicant/Advocates' services to the Respondent.
  • If the Applicant/Advocates wish to pursue taxation of further items, they must file a fresh bill of costs under the correct schedule before a different Taxing Officer.
