Procedural Posture

Judicial Review Application / Ruling on Application for Leave to Commence Judicial Review

  1. 1 Whether the applicants are entitled to leave to commence judicial review proceedings against the decision of the County Physical and Land Use Planning Liaison Committee.
  2. 2 Whether judicial review is available where a statutory appeal mechanism exists under the Physical and Land Use Planning Act.

Ratio Decidendi

The court found that the Physical and Land Use Planning Act provides a clear statutory mechanism for challenging decisions of the County Physical and Land Use Planning Liaison Committee, namely, by way of appeal to the Environment and Land Court. The applicants, instead of pursuing this statutory appeal, sought leave to commence judicial review proceedings. The court held that judicial review is not available where Parliament has provided a specific statutory redress mechanism, and that such mechanisms must be strictly followed. Consequently, the application for leave to commence judicial review was declined as the applicants had an alternative and adequate remedy by way of statutory appeal.

Court Disposition

Application for leave to commence judicial review proceedings declined.
