The court found that although there is no express statutory procedure for enforcement of Director of Occupational Safety and Health (DOSH) awards under the Work Injury Benefits Act (WIBA), the Employment and Labour Relations Court (ELRC) has jurisdiction to adopt and enforce such awards as orders of the court. The trial magistrate was correct in declining jurisdiction, as the Chief Justice's Gazette Notice No. 6024 of 2018 did not extend jurisdiction to magistrates to adopt DOSH awards.
