The Tribunal found that the landlord failed to provide sufficient evidence of a genuine and settled intention to use the premises for its own business, as required by Section 7(1)(g) of Cap 301. The landlord.s claim was undermined by the lack of supporting documentation such as a board resolution or business plan, and the timing of the notice closely followed the tenant.s refusal to pay a substantial goodwill sum. The Tribunal determined that the real motive for termination was the tenant.s refusal to pay goodwill, not a bona fide intention to occupy.
