Ratio Decidendi

The appellant produced his old driving license, which had classes D1, D2, and D3 stamped and authorized by the respondent. The law requires that particulars endorsed on a previous license be included in any new license issued. Since the respondent did not dispute the authenticity of the appellant's evidence and the Traffic Act mandates the transfer of such endorsements, the appellant is entitled to have the missing classes reinstated on his smart driving license. The respondent is therefore under a legal duty to update the appellant's smart driving license to reflect the classes previously authorized.

Court Disposition

Appeal allowed.

Orders

  • The respondent shall, effective immediately, reinstate classes D1, D2, and D3 on the appellant’s smart driving license.
  • Each party shall bear its own costs.
