The Tribunal found that while the landlord’s notice of termination was in the prescribed form and substantively compliant with the statutory requirements, the application to enforce the notice was filed prematurely, before the expiry of the mandatory two-month notice period stipulated under Section 4(4) of the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act Cap 301. The law requires that a notice of termination of a controlled tenancy must not take effect until after the lapse of the prescribed notice period.
