Ratio Decidendi

The High Court lacks jurisdiction to hear and determine disputes relating to the environment and the use, occupation, and title to land following the promulgation of the 2010 Constitution and the operationalization of the Environment and Land Court. Although the suit was instituted before the effective date of the Constitution, the transitional provisions are now spent, and the matter must be handled by the Environment and Land Court. The High Court cannot arrogate itself jurisdiction that is expressly ousted by the Constitution. Accordingly, the suit must be transmitted to the Environment and Land Court for further directions and disposal.
