Ratio Decidendi

The Tribunal found that although the tenancy agreement was for a fixed term of five years and three months, it contained a clause permitting either party to terminate the lease at any time during its term by giving two months' written notice. This provision for termination otherwise than for breach of covenant brings the tenancy within the definition of a controlled tenancy under section 2 of the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act. Consequently, the Tribunal held that it has jurisdiction to hear and determine the dispute. The landlord's preliminary objection was therefore dismissed.
