Procedural Posture

Succession Cause / Judgment on Application for Revocation/annulment of Grant

  1. 1 Is the application for revocation of grant res judicata?
  2. 2 Have the applicants established grounds for annulment of the grant under section 76 of the Law of Succession Act?
  3. 3 Is the respondent entitled to exclusive possession or to vacate the 2 acres in dispute?

Ratio Decidendi

The court found that the application for revocation of grant was not res judicata because the previous protest was dismissed for want of prosecution and not determined on merit. The court further held that the petitioner failed to disclose material facts, specifically the applicants' long-term occupation of the disputed land and her own prior benefit from the estate. This non-disclosure constituted sufficient grounds under section 76 of the Law of Succession Act to review and revoke the grant. The court therefore annulled the previous grant and ordered that a fresh grant be issued jointly to Lina Wanjiru Mwangi and Irene Wangui Mwangi, with liberty to apply for confirmation of the grant....
