Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the award of Kshs. 1 million in general damages for personal injuries was excessive in light of the medical evidence and authorities presented.
  2. 2 Whether the trial magistrate properly exercised discretion in assessing quantum of damages.

Ratio Decidendi

The High Court found that the trial magistrate had properly considered the medical evidence, the nature and extent of the respondent's injuries, and the authorities cited by both parties. The respondent suffered serious gunshot injuries, including a fractured scapula and collapsed lung, but had recovered sufficiently to continue working. The trial magistrate exercised discretion in awarding Kshs. 1 million in general damages, and there was no evidence that the award was so excessive as to warrant interference by the appellate court. The appellant failed to demonstrate any error in principle or fact in the assessment of damages. Accordingly, the appeal was dismissed and the award upheld.
