The Tribunal held that internal resolutions suspending refunds cannot override statutory obligations under the Sacco Societies Act, which mandates refund of member deposits within sixty days of withdrawal notice. The Respondent's financial difficulties and management challenges, while sympathetic, do not absolve it from compliance with the law. The Claimant's claim therefore succeeded in full.
