The Court found that although the application to strike out the appeal was filed out of time and was therefore incompetent under Rule 80 of the Court of Appeal Rules, the appeal itself was fatally defective. The omission of the second page of the Amended Defence, a primary pleading required by Rule 85(1)(c), meant that the record of appeal was incomplete and the appeal was incompetent. Rule 85(2A) prohibits the subsequent filing of a supplementary record to cure such an omission.
