The Tribunal found that Julius Kariuki Wangai lacked locus standi to bring the application for eviction and possession because he was not the registered proprietor of the suit premises, which belonged to Olkalou Central Farmers Co-operative Society Ltd. The notices to terminate tenancy were not issued by the co-operative society, and there was no evidence that the society had authorized Mr. Wangai to act or swear affidavits on its behalf. As a duly incorporated co-operative society, only the society itself or its authorized representatives could institute such proceedings. Consequently, the application was incompetent and was dismissed with costs to the respondent.
