The court found that the applicant failed to comply with the mandatory procedural requirements for instituting contempt of court proceedings. Specifically, there was no service of notice to the Attorney General prior to the application for leave, as required by Order 52 rule 2(3) of the Rules of the Supreme Court (England), which is applicable in Kenya by virtue of section 5 of the Judicature Act. Additionally, after leave was declined by Nyamu, J, the applicant did not file a fresh application as required by the rules.
