The Tribunal found that a controlled tenancy existed between the applicants and the 1st to 3rd respondents, who are beneficial owners of the estate. The Tribunal held that it has jurisdiction to protect tenants from unlawful eviction and distress for rent, even where succession proceedings are pending. The 3rd respondent. s failure to issue a statutory notice of termination rendered the attempted eviction and distress illegal and unprocedural.
