The Environment and Land Court lacks jurisdiction to entertain or proceed with any application or matter where there is a subsisting stay order issued by the Court of Appeal. In this case, the stay order granted by the Court of Appeal on 19th June 2015, which halted proceedings in the present suit pending the hearing and determination of the intended appeal, remains in force. The subsequent dismissal of the respondents' application to admit the appeal out of time did not extinguish the stay order, as the record of appeal had already been filed and the appeal was pending.
