Legal Issues
- 1 Whether the High Court can entertain a sentence revision application when an appeal is pending.
- 2 Whether there is any further action required in the file after the applicant's sentence has lapsed.
Ratio Decidendi
The court held that it could not entertain the application for sentence revision because there was a pending appeal before the High Court on the same matter. The existence of the appeal ousted the court's jurisdiction to consider the revision application. Furthermore, since the applicant's two-year sentence had already lapsed as per the Probation Officer's report, there was no further action required in the file. The file was accordingly closed and the lower court file ordered to be returned to the Winam Law Courts.
Court Disposition
Application for sentence revision rejected and file closed.
Orders
- The file is closed as there is no action pending.
- The lower court file to be returned to Winam Law Courts.
