Ratio Decidendi

The application for leave to file a notice of appeal and memorandum of appeal out of time was struck out because it was anchored on an appeal that had been filed unprocedurally, without a valid notice of appeal. The court found that the same issues had already been determined in a previous application before another judge, who had directed that the proper course was to withdraw the unprocedurally filed appeal and commence the process afresh. As the applicants had not complied with this direction and the circumstances had not changed, the court held that it could not properly determine the same issues again. The application was therefore found to be without merit and was struck out.
