The Tribunal found that the application dated 22nd January 2024 was incompetent as it was not anchored on a reference or complaint as required by the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act. The applicants failed to establish a landlord and tenant relationship with the 1st or 2nd respondents, as the lease with the 3rd respondent had expired on 30th September 2023, and there was no evidence of rent paid to the 1st or 2nd respondents. The Tribunal's jurisdiction is contingent on the existence of a controlled tenancy, which was absent after the lease expiry.
