The applicants' attempt to cure the defect by seeking leave to file the Notice of Appeal out of time could not succeed because the appeal itself was not properly before the court. The proper course would have been to withdraw the incompetent appeal and commence the process afresh. The court therefore struck out the application with costs to the respondent, without addressing the merits of the application for extension of time.
