Ratio Decidendi

The Court found that although the respondent failed to provide a satisfactory explanation for the delay in filing the appeal after the issuance of the Certificate of Delay, the applicant's application to strike out the notice of appeal was itself filed outside the statutory 30-day period required by the Court of Appeal Rules. As a result, the application was incompetent and could not be entertained, regardless of the merits regarding the respondent's delay. The Court therefore struck out the application for being time-barred, making no order as to costs.
