Procedural Posture

Miscellaneous Application / Ruling on Notice of Motion for Stay and Setting Aside of Warrants of Attachment

  1. 1 Whether the court should grant an order of stay of execution and/or set aside the warrants of attachment and police assistance issued in Milimani Miscellaneous Application E1705 of 2023.
  2. 2 Whether the warrants of attachment and/or police assistance issued by the 1st respondent were illegal, unprocedural, or unlawful.
  3. 3 Whether the application before the Kiambu High Court was an abuse of court process.

Ratio Decidendi

The court found that the applicant, having been the first to proclaim the subject motor vehicle, had precedence over the 3rd respondent, whose alleged beneficial rights as a secured creditor were not registered. However, since the applicant had already disposed of the vehicle by public auction, granting the orders sought would be futile. The court further held that the application was devoid of merit as the subject matter had already been overtaken by events, and there was no basis to annul or stay the warrants of attachment or police assistance issued by the 1st respondent. The application was therefore dismissed.
