Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the trial court erred in finding the appellants 100% liable for the accident.
  2. 2 Whether the trial court erred in the amount it awarded the respondent in general damages.
  3. 3 Whether the trial court erred in failing to award the respondent for loss of future earning capacity.

Ratio Decidendi

The appellants failed to adduce any evidence to support their defence, leaving the respondent's evidence unchallenged. The police abstract and oral testimony established that the appellants were fully liable for the accident. The trial court's award of general damages was based on the nature and severity of the respondent's injuries and was not inordinately high or based on wrong principles. The respondent's claim for loss of future earning capacity, although pleaded, was not proved as his termination was due to redundancy and not incapacity from the accident. The trial court's judgment was therefore correct on all issues, and both the appeal and cross-appeal failed.

Court Disposition

Appeal and cross-appeal dismissed. Trial court's judgment upheld. Each party to bear its own costs.
