Procedural Posture

Miscellaneous Application / Ruling on Post Judgment Application to Vacate Restriction

  1. 1 Whether the restriction prohibiting dealings with land title Konyu/Baricho/3720 should be vacated following the judgment delivered on 14/10/2022.
  2. 2 Whether the applicant is entitled to the removal of the encumbrance to facilitate registration of the discharge of charge.

Ratio Decidendi

The Tribunal found that the restriction prohibiting dealings with land title Konyu/Baricho/3720 was imposed to preserve the subject matter pending determination of the dispute. Since judgment had already been delivered on 14/10/2022, ordering the respondent to discharge the land title and release it to the applicant, the restriction had served its purpose. The respondent did not oppose the application despite being served. The Tribunal therefore allowed the application, vacating the restriction to facilitate the registration of the discharge of charge and closure of the file.
