Procedural Posture

Criminal Appeal / Judgment

  1. 1 Whether the prosecution proved the offence of stock theft against the appellant beyond reasonable doubt.
  2. 2 Whether the conviction was based on credible and sufficient circumstantial evidence.
  3. 3 Whether the trial court properly considered the appellant's defence and alibi.

Ratio Decidendi

The court found that the prosecution's case was based on strong circumstantial evidence, including the appellant's disappearance on the day the cows were stolen and corroborative testimony from the complainant and other witnesses. The appellant's defence and alibi were not credible in light of the evidence. The conviction for stock theft was therefore safe. However, while the sentence of seven years was lawful under section 278 of the Penal Code, the court considered the appellant's status as a first offender and reduced the sentence to five years' imprisonment effective from October 20, 2020.

Court Disposition

Orders
