The Tribunal found that the Respondent's Defence was devoid of substance, consisting only of bare denials without supporting evidence, and failed to raise any triable issue. The Respondent's conduct of making installment payments to the Claimant was deemed an admission of liability for the claimed sum. Consequently, the Tribunal struck out the Defence under Order 2 Rule 15 and entered summary judgment for the Claimant. The Tribunal ordered the Respondent to pay the outstanding balance of Kshs. 40,000/=, having already paid Kshs. 260,000/= out of the total Kshs. 300,100/= claimed, together with costs and interest from the date of filing the suit.
