The court found that the trial magistrate correctly interpreted the minutes of the Housing Development Management Committee, which required arrears to be considered per plot rather than cumulatively across multiple plots. As such, the suit property had not been lawfully repossessed from the 2nd Defendant, and the subsequent allocation to Rosemary Njambi was invalid. The evidence, including findings from related criminal and civil proceedings, established that the documents conferring title to Rosemary Njambi and subsequently to the Plaintiffs were forgeries. Therefore, the Plaintiffs could not acquire good title, and the trial magistrate erred in not cancelling the Plaintiffs' title....
