Procedural Posture

Criminal Revision / Ruling on Sentence Revision

  1. 1 Whether the applicant's custodial sentence should be revised in light of the Probation Officer's recommendation for community service.
  2. 2 Whether the applicant is suitable for a non-custodial sentence given the circumstances of the offence and time already served.

Ratio Decidendi

The court found that the applicant, having served a substantial portion of his custodial sentence for theft and handling stolen goods, was suitable for community service as recommended by the Probation Officer. The offences, while criminal, were not of a violent nature and the value involved was modest. The court exercised its revisionary jurisdiction to substitute the remainder of the custodial sentence with a community service order at Githioro Police Station for two months, in the interest of justice and to aid in decongesting the prison. The terms of the community service order were to be explained to the applicant.

Court Disposition

sentence revised; custodial sentence substituted with community service order

Orders

  • The applicant's custodial sentence is revised to a community service order for the remainder of the sentence, to be served at Githioro Police Station for two months.
  • The terms of the community service order shall be explained to the applicant.
