The application for stay was filed promptly, within the prescribed period after judgment. The court exercised its discretion to grant stay of execution on condition that the appellants deposit Kshs. 200,000 as security within 21 days, balancing the interests of both parties and ensuring the due performance of the decree if the appeal fails.
