The court found that the trial court failed to comply with the mandatory provisions of section 333(2) of the Criminal Procedure Code by not taking into account the period the applicant spent in remand custody prior to conviction and sentencing. The applicant was first arraigned on 8th June 2011 and remained in remand throughout the trial. The omission resulted in the applicant's sentence commencing from the date of sentencing, thereby excluding the remand period and leading to an excessive period of incarceration.
