Ratio Decidendi

The High Court found that the trial court exercised its sentencing discretion properly, considering the nature of the offences, the mitigation, and other relevant factors. Although a pre-sentence report would have been preferable, its absence did not render the sentence unlawful or excessive. Given the gravity of the offences, the manner in which they were committed, and the lack of recovery of stolen items, the sentence of five years' imprisonment on each count, to run concurrently, was not harsh or excessive. The appellate court found no basis to interfere with the sentence and dismissed the appeal.
