The court determined that it lacks jurisdiction to enlarge the time for filing employment claims beyond the statutory limitation period set out in section 89 of the Employment Act (Rev. 2024). The applicant's cause of action arose upon retirement in November 2016, and the statutory three-year limitation period expired in September 2019. The application to reinstate the dismissed application, filed in October 2023, was therefore time-barred. The court relied on binding precedent and statutory provisions to hold that reinstating the application would be futile, as it has no power to grant the substantive relief sought.
