The evidence showed that the party list published by IEBC did not contain the appellant's name as nominee for the Minority Group seat, but rather the 1st respondent's. There was no evidence that IEBC rejected or required amendment of the party list as alleged by the 2nd respondent. The subsequent gazettement of the appellant violated Article 177(1)(b) of the Constitution, Section 34(6A)(b) of the Elections Act, and Regulation 54(8) of the Elections (Party Primaries and Party List) Regulations 2017.
