Procedural Posture

Miscellaneous Application / Ruling on Interlocutory Application for Interim Relief

  1. 1 Whether the Employment and Labour Relations Court has jurisdiction to grant interim relief where an appeal is pending before the Public Service Commission.
  2. 2 Whether the applicants have established a prima facie case to warrant the grant of interlocutory injunctions restraining adverse employment actions.

Ratio Decidendi

The court held that while it has jurisdiction to grant interim relief to preserve the subject matter of an appeal pending before the Public Service Commission where the Commission cannot do so, the applicants failed to establish a prima facie case. The evidence showed that the applicants' fixed term contracts had expired on 11th October 2023, and there was no subsisting employment relationship at the time the application was filed. Without an existing employment relationship, there was no basis for the court to grant the interlocutory injunctions sought. Consequently, the applications for interim orders were declined.
