The court found that the Environment and Land Court's jurisdiction is not limited by the value of the subject matter, as there is no statutory threshold restricting its authority to matters above Kshs. 20,000,000. The Defendant's objection on jurisdiction was therefore baseless. On limitation, the court held that since the Plaintiff alleged fraud and only discovered the issue in 2013, the limitation period began to run from that date. The suit, filed in 2023, was thus within the permissible period. The preliminary objection failed on both grounds as it did not raise pure points of law and was not supported by the pleadings or the law.
