The court found that the applicant's delay of about two months in bringing the application was not inordinate and that the reasons advanced—primarily the delay in issuance of the certificate of delay and decree due to Covid-19 restrictions—were sufficient and outside the applicant's control. The court also determined that the intended appeal was arguable and that the applicant would suffer greater prejudice if denied the opportunity to appeal, as his right to be heard would be extinguished. The court, therefore, exercised its discretion in favour of the applicant and granted the extension of time sought.
