Preliminary Objection / Ruling on Preliminary Objection

  1. 1 Whether the present suit is barred by the doctrine of res judicata.
  2. 2 Whether the withdrawal of the previous suit (ELC No. 12 of 2019) constitutes a final determination on merits.
  3. 3 Whether the preliminary objection raised by the 1st defendant is sustainable.

Ratio Decidendi

The court found that the previous suit, ELC No. 12 of 2019, was withdrawn before any substantive hearing or determination on the merits took place. The issues in that suit were not canvassed or decided, and thus, the doctrine of res judicata does not apply. Section 7 of the Civil Procedure Act only bars subsequent suits where the matter has been heard and finally decided by a court of competent jurisdiction. Since the withdrawal of the previous suit did not result in a final judgment on the merits, the present suit is not barred. The preliminary objection, therefore, fails as it is premised on an inapplicable doctrine in the circumstances.

Court Disposition

preliminary objection dismissed
