The appellate court determined that the injuries, while serious, did not warrant such a high award and that the authorities cited by the appellants were more applicable. The court reduced the general damages to Kshs. 400,000, upheld the special damages of Kshs. 7,550, and applied a 20% deduction for contributory negligence. The court also ordered that the appellants receive half the costs in the lower court and half the costs of the appeal. The trial court's judgment was set aside and substituted with the new award.
