However, upon review, the appellate court determined that the award of Kshs.1,000,000/- for general damages was reasonable given the injuries sustained and upheld it. The court found that the respondent did not strictly prove the full amount of special damages pleaded and substituted the award for special damages with Kshs.89,100/-. Liability was upheld at 100%. Each party was ordered to bear its own costs on appeal.
