The trial magistrate forfeited the applicant's cash bail without affording her an opportunity to show cause as required by Section 131 of the Criminal Procedure Code. The applicant provided a reasonable explanation for her absence, which the trial court accepted by lifting the warrant of arrest, yet imposed new bail terms without justification. The forfeiture was therefore improper and in contravention of the law. Upon acquittal, the trial court failed to address the refund of the cash bail.
