The respondent was estopped from reneging on the verbal waiver and unlawfully deducted two months' salary from the claimant's terminal benefits. The court held that the claimant was not constructively dismissed, was not entitled to compensation or other reliefs, but was entitled to the Kshs 60,000 deducted for the unserved notice period. The rest of the claim was dismissed.
