Procedural Posture

Objector Application / Ruling on Objector's Applications to Set Aside Attachment and for Leave to File Notice of Objection

  1. 1 Whether the Objector's application without a Notice of Objection is competent under Order 22 Rule 51 of the Civil Procedure Rules.
  2. 2 Whether the Objector is entitled to leave to file a Notice of Objection after filing an ordinary application.
  3. 3 Whether the Objector has demonstrated sufficient grounds for review or setting aside of the Court's orders of 7th November, 2024.

Ratio Decidendi

The Court held that the Objector's applications were incompetent and without merit because they were not accompanied by a Notice of Objection as mandatorily required by Order 22 Rule 51 of the Civil Procedure Rules. The Objector could not cure this defect by seeking leave to file a Notice of Objection after filing an ordinary application. The Court further found that the Objector had not demonstrated any legal or equitable interest in the attached property, nor had it established any grounds for review or setting aside of the Court's previous orders. The applications were therefore dismissed with costs.

Court Disposition

Objector's applications dismissed with costs.

Orders
